1. Introduction

Welcome to AvellaHosting. By using our services, you agree to comply with and be bound by the following terms and conditions of service. Please review these terms carefully. If you do not agree with these terms, you should not use our services.

2. Services Provided

AvellaHosting offers web hosting services, including but not limited to shared hosting, virtual private servers (VPS), windows hosting and E-commerce hosting. We reserve the right to modify or discontinue any service at any time.

3. Account Registration

To use our services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Acceptable Use Policy

You agree to use our services only for lawful purposes. You are prohibited from:

Engaging in any activity that violates any local, state, national, or international law or regulation. Uploading, posting, or transmitting any content that infringes on the intellectual property rights of others. Using our services to distribute malware, viruses, or other harmful software. Engaging in any activity that disrupts or interferes with our services or servers.

5. Payment Terms

All fees for our services are due in advance. You agree to pay for the services provided on a timely basis. If payment is not received by the due date, we reserve the right to suspend or terminate your account and services.

6. Refund Policy

AvellaHosting does not offer refunds for any services rendered. All payments are final.

7. Data Backup and Recovery

While AvellaHosting takes data backup seriously, we do not guarantee the integrity and availability of your data. You are responsible for maintaining your own backups. AvellaHosting will not be liable for any data loss or corruption.

8. Termination

We reserve the right to terminate your account and services at any time, with or without notice, for any reason, including but not limited to violation of these terms. Upon termination, all data associated with your account may be deleted.

9. Limitation of Liability

AvellaHosting shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold Cloud Host, its affiliates, and their respective officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, arising out of your use of our services, your violation of these terms, or your infringement of any intellectual property or other rights of any person or entity.

11. Modifications to Terms

AvellaHosting reserves the right to modify these terms of service at any time. Any changes will be posted on our website and will take effect immediately upon posting. Your continued use of our services after any such changes constitutes your acceptance of the new terms.

12. Governing Law

These terms of service shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law principles.

General payment terms

1. Payment by debit/credit card via V-POS.

2. Types of cards accepted: Visa, Mastercard and bCard debit, credit and business cards.

3. Transactions are carried out using the MasterCard Identity Check and VISA Secure security programs.

4. We do not store data about bank cards used for payment through the site.

5. If it is necessary to return an amount paid with a bank card, it will be refunded to the same card.

Acceptable Use Policy (AUP)

1. Prohibited Activities

You may not use our services to engage in, foster, or promote illegal, abusive, or irresponsible behavior, including but not limited to:




• Illegal Activities: Hosting, disseminating, or promoting material that violates any applicable law or regulation.


• Harmful or Fraudulent Use: Engaging in activities that are deceptive, fraudulent, harmful to others, or violate the privacy of others.


• Spam and Unsolicited Emails: Sending unsolicited bulk messages or spam, including commercial advertising and informational announcements.


• Infringement of Intellectual Property: Hosting or distributing content you do not own or have the legal right to use (e.g., copyrighted materials, trademarks, software, music, or video).


• Distribution of Malware: Publishing or distributing viruses, worms, Trojan horses, corrupted files, or any other similar software or programs.


• Resource Abuse: Excessive consumption of system or network resources that disrupts the normal use of services for other users.


• Denial of Service (DoS) Attacks: Initiating or participating in any DoS or DDoS attacks.


• Unauthorized Access: Attempting to gain unauthorized access to any system, account, or network.

2. System and Network Security

Violations of system or network security are strictly prohibited, including but not limited to:



• Unauthorized access or use of data, systems, or networks.


• Probing, scanning, or testing the vulnerability of a system without proper authorization.


• Breaching authentication or security measures.

3. Content Restrictions

The following content is strictly prohibited on our platform:



• Child exploitation or pornography.


• Hate speech, threats, or content promoting violence.


• Content promoting or facilitating illegal activity.


• Material that defames, abuses, or threatens others.

4. Resource Usage

Users must not misuse server resources, including CPU, memory, and bandwidth. Activities that negatively impact server stability, such as excessive resource consumption or running resource-intensive processes, are not allowed. We may monitor resource usage and take action if necessary to ensure fair usage and performance.

5. Enforcement and Consequences

Violation of this AUP may result in:



• Temporary or permanent suspension of your account or services.


• Removal of content without prior notice.


• Legal action, if applicable.

We reserve the right to investigate suspected violations and cooperate with law enforcement if necessary.

6. Reporting Violations

If you believe a user of our services is violating this policy, please report it to us at abuse@avellahosting.com

7. Amendments

We may modify this AUP at any time by posting a revised version on our website. Continued use of our services after changes constitutes your acceptance of the revised policy.
